Scrapped 3K proposals were all ‘open-ended’


MUMBAI: Chief minister Prithviraj Chavan's decision to scrap two mega slum projects, approved under the 3K clause, was triggered by the fact that the deals were "open-ended".
Officials said the letters of intent issued by the slum rehabilitation authority (SRA) for the projects were not in keeping with the terms and conditions laid down under the clause.
On November 23, 2010, Lashkaria Constructions was issued a letter to develop a 55.27 lakh sq ft slum plot at Malvani in Malad, while Sterling Buildcon was issued another letter on December 7, 2010, for redevelopment of a 20.30 lakh sq ft plot at Borla in Chembur. The letters were issued on the basis of a circular issued by the SRA to the developers on November 12, which followed a directive from the housing department on November 11. The letters did not specify the timeframe for submitting the mandatory 70% or getting the layout approved, sources stated.
Unlike the slum schemes for individual plots, developers of projects approved under 3K can bypass the mandatory 70% consent norm at the time of issuance of the letter. But the 3K clause requires the appointed developer to submit 70% consent of the affected slum-dwellers and the annexure-II list, which decides the eligibility of the families, within six months of the letter being issued. Norms stipulate the layout plan for the slum cluster should be approved within a year of the letter's issuance, even which it was not specified in the letter and the SRA circulars.
The anomalies came to light in March, after a complaint by BJP national secretary Kirit Somaiya. "The deals were open-ended," a senior official said. The 3K clause was introduced for the development of integrated development of a slum cluster. But the absence of riders on the time-limit for consent and layout approval were seen as defeating the purpose. While the letters were issued after Prithviraj Chavan took over as CM, orders for the approval for the two schemes were granted on October 3 (Lashkaria) and 8 (Sterling Buildcon), during Ashok Chavan's term. Prithviraj Chavan also called for files of four proposals cleared from 2008 to 2009 under 3K.
